FRAME WAIVER OF LIABILITY
This section of the form should be completed and signed by the client, or by the clients legal guardian if applicant is
under 18 years of age, as well as by the client’s physician where indicated below.
WAIVER OF PARTICIPANT AGREEMENT
1. I voluntarily requested and agreed to partici-pate in the Frame exercise program (also referred to as “The Program”).
2. In consideration for being permitted to participate, I hereby agree and represent that: I understand that the
Frame exercise program and training will take resonable efforts to assure my safety while participating in the training and exercise
program. I understand however that there are unavoidable risks of physical injury or resulting damage such as heart at-
tack and stroke associated with any exercise training program, as well as activities incident thereto, (hereinafter referred
to as the “Program” or “participation in the Program”). I understand that these risks of injury/or damage may also be
caused by the third parties or circumstantial events over which neither Frame nor anyone for whom
Frame may be responsible or related, has control or could reasonably foresee.
3. I represent and warrant that I do not know of any medical condition, symptom or any other reason that would prevent
me from understaking the exercise and training Program or increase my risk beyond those inherent in the exercise and
training Program. I understand that the training and exercise program will be strenuous and involve a variety of exercise
4. I understand that Frame does not guarantee my safety or that I will remain free from injury and/or damage
5. I acknowledge and agree that my participation in the Frame exercise program is completely voluntary and
made with fullknowledge of the inherent of injury and/or damage that may occur during participation in the Program.
6. I understand that, although Frame has made reasonable efforts to assure my safety while participating in the
Program, that there are unavoidable risks in participation in the Program, and I hereby release and promise not to sue
Frame or any of their employees or agents for any damages or injury (including death) caused by, arising out of, or related
to my participatin in the Program.
7. I represent that all times during my particiaptin the Program I will be covered by health insurance to provide adequate
coverage for any injuries, illnesses or damages that I may sustain or experience. I certify that I
have confirmed that my health insurance will adequately cover any injuries, illnessess or damages that I may sustain or
experience. I hereby release Frame, and its employees and agents from any responsibility or liability for expenes
incureed by me for injuries or illnesses (including death) that I may incur because of those injuries or illnesses.
8. I agree to defend, indemnify and hold harmless (including attorney’s fees and costs) Frame from and against
all losses, claims, demands, liabilities or causes of action of every kind and character for personal injury to or
illness of or death fo any employee or invitee of Frame which injury, illness or death arises out of or is in con-
nection wit or is in any way incidental to my acts, fault, omission, negligence or breach of any obligation pursuant to the Program.
9. I understand that although Frame will attempt to maintain the Program as described to me, it reserves the
right to change the program, including the itinerary, travel arrangements, or accommodations at any time and for any
reason, with or without notice, and that Frame shall not be responsible or liable for any expenses or losses that I may sustain because
of these changes.
10. I understand that Frame reserves the right to decline to accept or continue to retain me in the Program at
any time should my actions or general behaviour, in the sole direction of Frame be determined to impede, ob-
struct, or present a risk of harm to me or others a"liated with the Program in any way.
11. I agree that, should any provision or aspect of this Agreement be found to be unenforceable, that all the remaining
provisions of the Agreement will remain in full force and effect.
12. I represent that my agreement to the provisions herein is wholly voluntary, that the provisions herein are understood
by me and are reasonable. I further understand that, prior to signing this Agreement, I have the right to consult with any
advisor, counselor, or attorney of my choice.
13. I understand that FRAME is not required to provide a refund for cancelled contracts and the fees may be applied.
14. I understand that I will be required to give my trainer at least 24hrs notice when schedule changes are necesssary.
15. I agree that, should there be any dispute concerning my participation in the Program that will require my adjudication
of a court of law, such adjudication will occur in the courst of and be determined by the laws of the State of Texas and
venue shall only be proper in the State of Texas.
16. This Agreement represents my complete understanding with Frame concerning its responsibility and liability
for my participation in the Program and that it supersedes and previous or contemporaneous understandings. I may have
had on this subject, whether written or oral, and that this agreement cannot be changed or amended in any way without
written occurrence. The language and all parts of this Agreement shall be constituted in all cases according to its fair
meaning, and not for or against either party to this Agreement. The rule of construction of the e!ect that any ambigui-
ties against the drafting party shall not be employed in the interpretation of this Agreement.
